Hi what does 50/50 mean in insurance what happens to repairs of vehicles and personal injury
50/50 is the terminology used to show that each party involved in an accident accepts half of the blame. So each party will recover half of their losses. The value of your claim is calculated, and you get half.
The legal principle is called contributory negligence. It means I might be to blame for an accident, but you might be partially to blame. So in simple terms, I did not see you, but you should not have been travelling so fast. That is the usual accusation thrown at a bike rider. Your partial fault will be assesses at a percentage figure, and lets say 30%. You only receive 70% of the value of your claim, and I am entitled to claim 30% of he value of my claim.
A collision in a narrow line is a good example, particularly when both vehicles are still moving at the time of the collision.
Do make sure you get good advice before accepting partial fault. Not only will it reduce the value of your claim, it will mean your own insurer will have to pay up, and that means increased insurance premiums.
There is no magic to the assessment as anyone using common sense can make a worthwhile judgment. But when you are involved in an accident it is difficult to accept you might have contributed in some way. You have to step back and be objective.

If you left a pole across a road and someone ran in to it, I think you would accept blame. You, just like anyone else has a duty in law to take reasonable care for others.
